Marketing Penguin ("we", "us") is a digital marketing agency operated from Delhi NCR, India, providing website development, SEO, social media marketing, Google Business Profile management and paid advertising services.
Each engagement is defined by a written proposal or invoice describing scope, deliverables, timelines and fees. Work outside that scope is quoted separately before it begins.
Project work is typically billed 50% in advance and 50% on completion. Monthly services are billed in advance. International payments are processed in USD via our payment provider (Razorpay); Indian payments in INR. Applicable taxes (including GST) are added where required.
You agree to provide timely access, content, approvals and account credentials needed to deliver the work, and confirm you have rights to all materials you supply.
We commit to the work described in your scope and to transparent reporting. Marketing outcomes (rankings, traffic, leads) depend on factors outside any agency's control, and specific results are not guaranteed.
On full payment, deliverables created for you (website, content, creatives) belong to you. We retain the right to reference non-confidential work in our portfolio unless agreed otherwise in writing.
Monthly services may be cancelled with 30 days' written notice. Fees for work already performed remain payable.
Our total liability under any engagement is limited to the fees paid for that engagement in the preceding three months. We are not liable for indirect or consequential losses.
These terms are governed by the laws of India, with courts in Delhi having jurisdiction.
